Driver & Operator Terms

These terms apply if you use Msafiri to carry passengers or parcels — whether you drive your own vehicle, drive for someone else, or run a transport company that lists trips and vehicles through the Msafiri Solutions dashboard.

They are in addition to our Terms of Service. Where the two conflict on a driver-specific point, these terms apply.

You are an independent service provider. Nothing in these terms creates an employment relationship, partnership, joint venture or agency between you and Msafiri.

You decide whether, when and where to drive, which trips to publish, which bookings to accept, and what fare to charge. Msafiri does not set your prices, does not require you to accept any booking, and does not supervise how you drive.

Because you are independent, you are responsible for your own tax affairs, including registering with and declaring your income to the Namibia Revenue Agency, and for your own business expenses, insurance and social contributions.

Before carrying passengers or parcels through Msafiri, and at all times afterwards, you must hold and maintain:

• a valid Namibian driving licence for the class of vehicle you operate
• any professional driving permit required by Namibian law for carrying passengers or goods for reward
• a valid road carrier permit or public passenger transport authorisation, where the law requires one for the service you provide
• valid vehicle registration and a current roadworthy certificate
• insurance appropriate to carrying fare-paying passengers or goods

You must upload these documents to Msafiri for verification and keep them current. If a document expires or is revoked, you must stop accepting bookings and tell us immediately. We may suspend your ability to accept bookings until valid documents are provided.

You are responsible for confirming which permits your specific operation requires. Being verified on Msafiri does not mean we have confirmed you hold every permit Namibian law requires of you.

Every vehicle you list must:

• be roadworthy, legally registered and properly maintained
• have working seatbelts for every passenger seat you sell
• match the details you listed, including make, type and seating capacity
• be clean and safe for passengers and any parcels you accept

You may not sell more seats than the vehicle is licensed to carry. Overloading is a serious breach of these terms and of Namibian road traffic law.

When carrying passengers or parcels booked through Msafiri, you must:

• drive within the speed limit and obey all road traffic laws
• never drive under the influence of alcohol or drugs, or while impaired by fatigue or medication
• treat every passenger with respect, without discrimination on the basis of race, ethnicity, sex, religion, disability, nationality or any other protected ground
• depart from and arrive at the points you agreed, and tell passengers promptly if you are delayed or must cancel
• take reasonable care of parcels in your custody and hand them over only to the intended recipient
• not solicit payment outside the agreed fare, and not pressure passengers to transact off the platform

You may refuse or end a trip where you reasonably believe your safety is at risk, where a passenger is abusive or intoxicated, or where you suspect a parcel contains a prohibited item.

If you operate as a transport company through Msafiri Solutions, you are responsible for the drivers you add to your account. In particular you must ensure that each driver holds the licences and permits described above, that each vehicle you list is roadworthy and insured, and that your drivers follow these terms.

You must not give dashboard access to anyone who is not authorised to act for your company, and you must remove access promptly when someone leaves.

Your company remains liable to passengers for trips carried out under your account.

You set the fare for the trips you publish, and it is shown to passengers before they book. Fares must be clear and must not be increased after a booking is accepted.

Where Msafiri charges a service fee or commission on bookings, the current rate will be shown to you in the app or dashboard before it applies. We will give reasonable notice before changing it.

You are responsible for maintaining insurance appropriate to your operation. Msafiri does not provide insurance cover for you, your vehicle, your passengers or the parcels you carry.

You are responsible for loss of or damage to parcels while they are in your custody, and for injury or loss caused by your negligence or by the condition of your vehicle.

We may review your documents, monitor safety reports about you and take account of passenger feedback.

We may suspend or remove your access where documents expire or cannot be verified, where we receive credible safety complaints, where you breach these terms, or where we are required to act by law. Where it is reasonable and safe to do so, we will tell you why and give you a chance to respond.

Serious matters — driving under the influence, violence, harassment, carrying prohibited goods, or operating without a valid licence — will result in immediate removal and may be reported to the authorities.

You indemnify Msafiri Technologies (Pty) Ltd against claims, losses, fines, penalties and reasonable legal costs arising from the transport services you provide, your breach of these terms, your breach of any law or permit condition, or loss or damage to any passenger, third party or parcel in your care.

These terms are governed by the laws of Namibia, and the courts of Namibia have jurisdiction over any dispute.
